Terms of Service

The short version
- You own the photos you upload and the creations you make with them.
- Sparks are prepaid credits. They have no cash value and don't expire while your account is open.
- Only upload photos you have the right to use, and don't use Recess to harm or impersonate anyone.
- AI results vary. Check anything before you rely on it or publish it.
- Purchases go through Apple, so Apple's refund process applies.
This summary is here for readability. The sections below are the agreement.
1. Who these terms are with
Recess is operated by SaveSmart, a company registered in South Africa (registration number [COMPANY REGISTRATION NUMBER], registered address [REGISTERED ADDRESS]). "We", "us" and "our" mean SaveSmart. "You" means you, the person using Recess.
By creating an account or using Recess you agree to these terms. If you don't agree, please don't use the app.
2. Who may use Recess
You must be at least 13 years old. If you are under 18, you may only use Recess with the consent of a parent or guardian who agrees to these terms on your behalf. You must not be barred from using the service under the laws that apply to you.
3. Your account
You sign in with Apple, Google or a one-time email code. Keep your sign-in method secure — anything done through your account is treated as done by you. Tell us promptly at pete@savesmart.co.za if you think someone else has access.
One person, one account. Where the same email address or provider identity is safely matched, we link those sign-in methods to a single account with a single Spark balance.
4. What Recess does
Recess lets you choose a published finish, add one or more of your own photos, and receive an AI-generated image or video result. What you get depends on the finish you choose and the photos you provide. Available finishes change over time, and we may add, update or withdraw them.
5. Sparks and purchases
- What Sparks are. Sparks are prepaid credits used to pay for creations. They are a limited licence to use the service — not money, not a stored-value instrument, and not property. They have no cash value and cannot be transferred, sold or exchanged for cash.
- Price before you start. Every finish shows its Spark price before you begin. We charge your balance when a creation starts.
- Refunds of Sparks. If a creation fails, times out, or you cancel it before it finishes, we return those Sparks to your balance automatically. If a creation completes but you don't like the result, the Sparks are used — AI results vary by nature, and the processing cost has already been incurred.
- Expiry. Sparks don't expire while your account is open. If you delete your account or we close it, any remaining Sparks are forfeited.
- Buying Sparks. Purchases are made through the Apple App Store and are charged to your Apple account. Apple, not us, handles billing. Money refunds are requested from Apple through their process and are granted at Apple's discretion, subject to your legal rights.
- Statutory rights. Nothing here limits any refund or cancellation right you have under the consumer law that applies to you, including the South African Consumer Protection Act.
- Price changes. We may change Spark prices and package pricing. Changes never affect Sparks you have already bought.
6. Your content and what you own
You keep ownership of the photos and videos you upload ("your content") and, as between you and us, you own the creations Recess produces for you ("your creations"). You are free to use, post, print and sell them, subject to these terms and the law.
You give us a limited, worldwide, royalty-free licence to host, store, transmit and process your content and your creations — only for the purpose of operating the service and producing the result you asked for. This licence ends when the content is deleted. We do not use your content or creations to train AI models, and we will not use them in marketing without asking you first.
7. What you must not do
Don't use Recess to:
- upload photos of anyone without their permission, or any photo you don't have the rights to use;
- create sexual, nude or suggestive content of anyone, or any sexual content involving minors;
- impersonate a real person, or create content designed to mislead people about what someone said or did;
- harass, defame, threaten, bully or degrade anyone;
- create content that promotes violence, hatred or illegal activity;
- break any law, or infringe anyone's copyright, trade mark, privacy or personality rights;
- reverse engineer, scrape, or attempt to extract the models, prompts or workflows behind the finishes;
- bypass Spark charges, security measures or rate limits, or use automated systems to access the service; or
- resell or make the service available to others as your own product.
You are responsible for what you create and where you publish it. If you publish an AI-generated image or video of a real person, label it as AI-generated where the law or the platform requires it.
8. Moderation and enforcement
We may refuse, block or remove a creation, and suspend or close an account, where we reasonably believe these terms have been broken or the law requires it. Where it is fair to do so, we will tell you why and give you a chance to respond. If we close your account for a serious or repeated breach, unused Sparks are forfeited.
9. AI results
Recess generates results using AI models. Results are probabilistic: they vary between runs, they may contain errors or artefacts, and they may not match what you pictured. Recess is designed to keep you recognisable, but no system is perfect. Creations are for personal and creative use — do not treat them as an accurate record of a real event, person or place, and don't use them where an unaltered photograph is required, such as identity documents or insurance and legal evidence.
10. Availability and changes
We work to keep Recess available, but we don't promise uninterrupted service. We may change, suspend or discontinue features, and we may run maintenance. If we discontinue the service entirely, we will give reasonable notice so you can save your creations, and we will handle unused Sparks fairly.
11. Our intellectual property
Recess — the app, the website, the finishes, the workflows behind them, the name and the branding — belongs to us and our licensors. These terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, and nothing more.
12. Apple
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you. Apple's own terms, including the Apple Media Services Terms and Conditions, also apply to your use of the App Store.
13. Third-party services
Recess relies on third-party providers to sign you in, host your data, process payments and generate results. Those providers are listed in our Privacy Policy. We are not responsible for their services, and their terms apply to their part of the process.
14. Warranties and liability
Recess is provided "as is" and "as available". To the fullest extent the law allows, we exclude all implied warranties, including fitness for a particular purpose and uninterrupted or error-free operation.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost data, or loss of goodwill. Our total liability to you for any claim connected with Recess is limited to the greater of the amount you paid us in the twelve months before the claim arose, or ZAR 1,000.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, for fraud, or under the South African Consumer Protection Act.
15. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your content, your creations, your use of Recess, or your breach of these terms or the law — for example, a claim by someone whose photo you uploaded without permission.
16. Ending your use
You can stop using Recess and delete your account at any time from Profile → Account settings in the app. We may end this agreement if you breach these terms, or on reasonable notice if we discontinue the service. Sections that by their nature should survive — ownership, liability, indemnity and governing law — survive the end of this agreement.
17. Changes to these terms
We may update these terms. We will update the date at the top of this page, and for significant changes we will tell you in the app or by email before they take effect. If you keep using Recess after a change takes effect, you accept the updated terms.
18. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. Disputes will be dealt with by the courts of South Africa, and you and we agree to their jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of the country you live in.

19. General
If a provision of these terms is found unenforceable, the rest continues to apply. Our not enforcing a right straight away doesn't waive it. You may not transfer your rights under these terms; we may transfer ours as part of a business transfer. These terms and the Privacy Policy are the entire agreement between us about Recess.
